Waste management
Waste management is one of the major issues facing Romania in terms of environmental protection. As defined in Law no. 211/2011, this means “the collection, transport, exploit and disposal of waste, including the supervision of such operations [...]”.
According to the Law no. 211/2011 on waste regime, the main obligations of the business operators are:
- To classify each type of waste generated from its own activity in the waste list;
- To carry out and to have a characterization of hazardous waste generated by its own activity;
- To comply with the codes set out in annex no. 2 to the Government Decision no. 856/2002 on the waste management record of each type of waste generated by its own activity;
- To exploit generated waste according to the waste hierarchy (prevention, preparation for re-use, recycling, other exploit operations, e.g. energy exploit, disposal);
- To collect separately at least the following categories of waste: paper, metal, plastic and glass;
- In the case of the authorized business operators, the obligation to ensure separate collection and not to mix them during transportation is added;
- To have dedicated storage facilities and to avoid stockpiling;
- Legal entities that are manufacturers and / or importers have the obligation to cover the costs of waste management from the municipal waste to which the manufacturer's extended liability applies;
- To designate a person to observe and ensure the fulfilment of the obligations provided by this law. The designated persons must be trained in the field of waste management, including hazardous waste, as a result of graduating specialized courses.
- To provide chronological records of waste management for each type of waste and keep it for at least 3 years.
The finding of contraventions and the application of sanctions are made by:
- The National Environmental Protection Agency
- The local public administration authorities and their empowered personnel
