Regulatory acts
According to the definition in article 2, item 2 of the Government Emergency Ordinance no. 195/2005 on the environmental protection regulatory act means “EA decision phase, environmental notice, environmental permit, environmental authorization, integrated environmental authorization, greenhouse gas emission authorization, authorization for activities with genetically modified organisms“.
The Environmental Authorization
The Environmental Authorization is “the administrative act issued by the competent authority for environmental protection setting out the conditions and / or operating parameters of an existing activity or a new activity with a possible significant impact on the environment, mandatory for commissioning”.
The Environmental Permitde
The Environmental Permit is “the administrative act issued by the competent authority for environmental protection, setting out the conditions and, where appropriate, the environmental protection measures to be followed when a project is being carried out.”
The Environmental Notice
The Environmental Notice is “the administrative act issued by the competent authority for environmental protection, which confirms the integration of the environmental aspects into the plan or program to be adopted”.
Water Management Authorization
According to the Water Law no. 107/1996, with subsequent amendments and completions, the groundwater may be used for other purposes than the water supply of the population and the animals only on the basis of the water management authorization.
Wastewater Takeover Agreement
According to article 7 of annex no. 2 to the Decision no. 188/2002 approving some norms regarding the discharge conditions in the aquatic environment of the sewage - “The waste water evacuation in the sewage networks or in the wastewater treatment plants is made on the basis of the written disposal acceptance given by the public service operator that administers and exploits the sewerage network and the wastewater treatment plant as well as the contract for the water service connection / sewer service connection and use of the public water supply and sewerage services concluded with it. “.
